Defense in German narcotics and drug criminal law
In German drug cases, substance, quantity, individual role and evidence can change the legal classification of the entire case.
German drug criminal proceedings range from possession allegations to extensive investigations into trafficking, import, groups or non-small quantities. Since the reform of German cannabis law, an important distinction must be made: many cannabis cases are now governed by the Konsumcannabisgesetz (KCanG), while other narcotics remain subject to the Betäubungsmittelgesetz (BtMG).
For the defense, substance, net quantity, active ingredient, individual role and the attribution of chats, phones or payments can be decisive. Many cases begin with a house search in Germany or the seizure of smartphones.
Do not make statements about the origin of substances, quantities or other people before the German investigation file has been reviewed. We defend clients throughout Germany under the BtMG and KCanG.

What matters now
The first steps after a narcotics or cannabis allegation in Germany.
Keep the police summons, search warrant, seizure inventory and other documents. Do not explain who owns substances, where they came from or what payments were for. In multi-defendant cases, improvised statements may have far-reaching consequences.
Important: Do not delete chats, alter data or manipulate evidence. Do not voluntarily disclose PINs, passwords or explanations about devices and accounts before obtaining legal advice.
The German investigation file must first show which specific act is alleged: possession, acquisition, supply, trafficking, import or participation in the conduct of others. A broad label such as “drug trafficking” does not define the individual legal allegation.
In many cases, quantity and active ingredient are crucial. The seized weight, laboratory analysis and any alleged non-small quantity must be reviewed carefully. Early police estimates are not always sufficient.
Smartphones, messenger chats, location data and contacts often play a major role in German drug cases. We examine who can actually be linked to a device or account, what messages mean in context and whether the data were lawfully obtained. Search and seizure issues are addressed on our House Search in Germany page.
Trafficking, joint conduct and mere possession must be kept separate. Not every transfer, payment or message proves criminal trafficking. The individual contribution and the evidence supporting it are decisive.
Cannabis is no longer assessed across the board under the BtMG. Section 34 KCanG contains separate criminal provisions, including rules concerning certain possession quantities, trafficking, import, supply and non-small quantities. The applicable statute must be identified first.
Serious German narcotics allegations can involve arrest warrants and pre-trial detention. Flight risk or risk of interference may be argued from the scale of the case, contacts and expected sentence. Detention therefore requires a separate and early defense strategy.
Confiscation, cash, account activity or allegations of organized structures may also arise. We therefore examine not only the seized substance but the complete evidential picture and the inferences drawn by investigators.
How we help
Defense under the German BtMG and KCanG
We obtain the file in the German investigation proceedings, review substance, quantity, active ingredient, laboratory results, the search, digital communications and the alleged individual role. Only then do we decide whether a statement, evidentiary application, detention defense or another step is appropriate.
Define the exact allegation
We separate possession, acquisition, supply, trafficking, import and participation and ask which allegation against our client can actually be proved.
Review quantity and active substance
The seized quantity and active ingredient are reviewed against the laboratory documents. In cases involving a non-small quantity, precise details can materially affect the legal classification.
Analyze digital evidence
Chats, phones, location data and financial movements are assessed in context. Attribution and interpretation must be reliable.
Set the defense objective
After access to the file, we define the defense objective, such as dismissal, narrowing the allegation, release from detention or defense at trial.

BtMG and KCanG must be kept legally separate
Possession, trafficking, import and non-small quantities are very different allegations
For narcotics other than cannabis, Section 29 BtMG contains numerous basic offences, including unlawful possession, acquisition, trafficking and import. Sections 29a, 30 and 30a BtMG may provide substantially higher minimum penalties where non-small quantities or other aggravating circumstances are alleged.
Cannabis is now governed in many situations by the KCanG. Section 34 KCanG contains its own criminal offences and also differentiates according to conduct, quantity and aggravating circumstances.
The first defense question is therefore not only “which drug?” but also: Which statute, which quantity, which active ingredient and which individual act can actually be proved?

Why specialized defense matters
German narcotics investigations are evidence-heavy and can have serious consequences at an early stage.
Criminal defense in complex drug cases
Large German drug cases often involve multiple suspects, extensive communications data and substantial files. We structure the evidence and separate provable facts from investigative assumptions.
Separate assessment under BtMG and cannabis law
Since the KCanG, cannabis cases should not automatically be assessed by the old BtMG framework. We identify the current German statutory basis for the specific allegation.
Experience with chats, phones and financial investigations
Chats, phones, cash, account movements and location data are often combined. The decisive question remains which data can actually be attributed to our client and to a specific alleged offence.
Early defense after searches and where detention is threatened
Searches, arrests and detention create significant pressure. That is precisely why a substantive statement should wait until the file is known and the strategy is agreed.
