Defense in German traffic criminal law
When a criminal charge and your driving licence are both at risk, the defense must address both from the start.
A criminal allegation arising from road traffic in Germany may affect not only the criminal penalty but also the driving licence and therefore work and everyday life. Typical cases include drunk driving, leaving the scene of an accident, dangerous driving, illegal motor racing and driving without a licence.
We review the evidence, including blood analysis, witness statements, accident traces, video and vehicle data, and assess whether provisional measures against the driving licence can be challenged. Our detailed guides on driving under the influence in Germany and hit and run under Section 142 StGB supplement this central service page.
Do not make an improvised statement about the driving, alcohol consumption or accident. We obtain the file in the German investigation proceedings and build the defense around the actual evidence.

What matters now
The first steps after a traffic criminal allegation in Germany.
Keep police letters, summonses, accident records, photographs and other documents. Do not make a spontaneous statement about the driving, alcohol or drug consumption, or the sequence of events. If your driving licence has already been seized or provisionally withdrawn, the legal basis and possible remedies should be reviewed immediately.
Important: Do not continue driving if your licence has been provisionally withdrawn or a valid driving ban applies. Whether seizure of the licence or provisional withdrawal is lawful is a separate question for legal review.
A police summons or written hearing should not lead to an improvised statement. In German traffic criminal law, details about the identity of the driver, perception of an accident, measured values and the precise timeline can be decisive.
In alcohol- or drug-related cases we review the blood sample, analytical values, signs of impairment and the question of fitness to drive. Our article on unfitness to drive under German law explains the general framework.
For an allegation of leaving the scene of an accident under Section 142 StGB, important questions include whether the accident was noticed, what findings could be made and whether the statutory requirements are actually met. See also our guide on hit and run in Germany.
Cases under Section 315c StGB or Section 315d StGB may depend on the exact driving conduct, a concrete danger, intent and reconstruction of the event. Video, vehicle and location data can become central evidence.
E-scooters are motor vehicles under German traffic law. Alcohol or drugs may therefore trigger criminal and driving-licence consequences. Our guide on e-scooters and alcohol in Germany covers this situation in more detail.
After a road accident, photographs, vehicle data, repair records and potential witnesses should be preserved early. At the same time, the defense must review whether the evidence was lawfully obtained and whether the conclusions drawn from it are justified.
In addition to a criminal penalty, Section 69 StGB may lead to withdrawal of the driving licence where the offence shows that the person is unfit to drive. The possible licence consequences should therefore be part of the defense from the outset.
How we help
Criminal defense with the driving licence consequences in view
We obtain the German investigation file, review the identity of the driver, measured values, accident reconstruction, witnesses and digital evidence, and develop a strategy that addresses both the criminal case and the driving licence.
Define the allegation
We first determine which German criminal offence is actually alleged and which objective and subjective elements must be proved.
Test the evidence
We review blood values, measurements, accident traces, video, vehicle data and witness evidence and identify contradictions or evidential gaps.
Protect the driving licence
Where provisional withdrawal, final licence withdrawal or a disqualification period is threatened, we include those risks in the defense from the beginning.
Choose the right procedural strategy
After reviewing the file, we decide whether silence, a written statement, evidentiary applications or another procedural step is appropriate.

Traffic criminal cases usually have two dimensions
Criminal penalties and driving-licence consequences must be assessed together
German traffic criminal law includes a number of separate offences. Section 316 StGB covers driving while unfit due to alcohol or other intoxicants; Section 315c StGB covers dangerous driving that creates a concrete danger; Section 315d StGB criminalizes prohibited motor races and certain solo-racing conduct; Section 142 StGB concerns leaving the scene of an accident.
In addition, Section 69 StGB may result in withdrawal of the driving licence if the offence demonstrates unfitness to drive.
For that reason, the defense should not focus only on a possible fine or custodial sentence. Loss of the licence and the resulting professional and personal consequences may be equally important.

Why our experience matters
German traffic criminal proceedings require quick decisions and careful review of technical and factual evidence.
Criminal defense in complex traffic cases
Traffic criminal law is criminal law. We assess the allegation under the same German criminal-procedure standards as any other investigation.
Driving-licence consequences considered from the beginning
For many clients, the driving licence is essential for work or family responsibilities. That does not change the legal test, but it matters when assessing procedural strategy and consequences.
Experience with alcohol, drugs and accident cases
Blood analysis, measurement data, accident traces, videos and vehicle data must be evaluated technically and legally. The conclusions in the police file are not automatically correct.
No premature statement before access to the file
An early statement may unnecessarily restrict the defense. We decide only after access to the file what, if anything, should be said.

Frequently asked questions about traffic criminal law in Germany
German Traffic Criminal Law – Frequently Asked Questions
German traffic criminal law includes offences such as drunk driving, dangerous driving, leaving the scene of an accident, prohibited motor racing and driving without a licence.
No. An administrative traffic offence is dealt with differently from a criminal offence. The procedure and possible consequences are not the same.
A suspect should generally not make an improvised statement about the allegation. The German investigation file should be reviewed first.
Yes, depending on the allegation. In certain traffic criminal cases the licence may be provisionally withdrawn and later withdrawn under Section 69 StGB.
Blood values can be important, but they are not always the only relevant evidence. Depending on the allegation, driving behavior, signs of impairment and timing may also matter.
Yes. E-scooters are motor vehicles under German law, and alcohol or drug offences can also affect an existing car driving licence.
In a Section 142 StGB case, whether the accident was noticed and what findings were possible after the event can be central issues. The file must be reviewed in detail.
An MPU is not an automatic part of every criminal case. Whether it later becomes relevant depends on the allegation, measured values, prior history and the German driving-licence authority.
Whether the matter ends with dismissal, a penalty order or a trial depends on the allegation and evidence. The likely route can be assessed more reliably after access to the file.
Do not make rushed statements, especially when your German driving licence may be affected.
