Defense against money laundering allegations in Germany
When bank accounts, transactions or assets become part of a German criminal investigation, the money flows must be analyzed precisely.
German money laundering investigations often begin with unusual bank movements, cash transactions, business payments, crypto transfers or suspicion that assets originate from criminal conduct. Account restrictions, a German asset seizure or arrest or a house search in Germany may have serious effects before the allegation has been resolved.
Section 261 StGB covers different forms of dealing with an object derived from an unlawful act. The defense must examine whether the alleged criminal origin can actually be proved, which act is attributed to our client and what the client knew or, in the relevant cases, recklessly failed to recognize.
Do not make spontaneous explanations about payments, accounts, wallets or business partners. We obtain the file in the German investigation proceedings and reconstruct the transactions from the evidence.

What matters now
The first steps after a money laundering allegation in Germany.
Keep letters from German police, prosecutors, courts or banks, together with account statements, contracts and transaction records. Do not alter data or move assets in reaction to the investigation. A substantive statement should not be made without a coordinated defense strategy.
Important: An account restriction or asset arrest is not the same as a conviction. The legal order, the amount secured and the attribution of specific assets must be reviewed separately.
Section 261 StGB requires an object that originates from an unlawful act. The alleged predicate offence and the evidential link between that offence and the particular asset are central defense questions.
German investigators may analyze account movements over long periods. We reconstruct incoming and outgoing payments, contracts, consideration and economic purpose and compare the real background with the investigative theory.
Different variants of Section 261 StGB require intent or, in certain circumstances, reckless failure to recognize the criminal origin. The defense must therefore examine what information the client actually had and what can reasonably be inferred from it.
German searches, account inquiries and seizures can generate extensive data. We review the legal measure and the attribution of documents, devices and assets. For an ongoing search, see our House Search in Germany page.
Crypto transactions can be traced, but they do not explain themselves. Wallet attribution, exchange accounts, transaction history and economic purpose must be reconstructed carefully. Where crypto is involved, our Crypto practice may also be relevant.
A common risk arises where a bank or payment account was used for third-party transfers. Whether the account holder knowingly participated in money laundering, acted recklessly or was themselves deceived must be assessed from the communications and circumstances.
Confiscation, asset arrest and account restrictions can be economically more disruptive than the allegation itself. We therefore address these measures in parallel with the substantive criminal defense.
How we help
Defense under Section 261 StGB – from initial suspicion to the end of proceedings
We obtain the German investigation file, reconstruct payment flows, test the alleged predicate-offence link and subjective knowledge, and defend against asset measures. This page is part of our White-Collar Crime practice.
Establish the alleged criminal origin
We identify the unlawful act said to be the source of the assets and test whether the specific property can actually be linked to it.
Reconstruct the money flows
Accounts, cash, contracts, invoices, wallets and communications are reconstructed chronologically and economically. Legitimate explanations must be tested against the investigative theory.
Test knowledge and recklessness
We examine which information the client actually had and whether intent or recklessness can be supported by the evidence.
Challenge asset measures
Asset arrest, account restrictions and confiscation issues are challenged separately where the amount, attribution or legal requirements are not supported.

Money laundering cases are often driven by financial and digital data
Origin, alleged act and subjective knowledge must be assessed separately
Section 261 StGB criminalizes several forms of dealing with an object derived from an unlawful act, including concealment, certain transfers or conversions, obtaining the object and, under the statutory conditions, keeping or using it. Concealing facts relevant to locating or tracing such property can also be covered.
The basic offence carries imprisonment of up to five years or a fine. Section 261(5) StGB provides higher penalties for particularly serious cases, while Section 261(6) covers reckless failure to recognize the criminal origin in certain situations.
The defense must therefore separate three questions: Where did the asset come from, what act is attributed to the client, and what did the client know or recklessly fail to recognize? An unusual transaction alone does not prove money laundering.

Why our experience matters
German money laundering cases combine criminal law, asset recovery and often complex business or digital evidence.
Certified Advisers in White-Collar Criminal Law (DAA)
German money laundering allegations often sit at the intersection of white-collar crime, criminal tax law and general criminal law. We structure these areas and avoid inconsistent explanations.
White-collar and criminal tax law considered together
Business payments must be tested against contracts, invoices, services and commercial purpose. An unusual payment is not automatically criminal.
Experience with accounts, crypto and digital evidence
Account and wallet data, chats and financial records can create enormous data sets. The key question is which transactions can actually be attributed to the client and the alleged conduct.
Early defense against asset-freezing measures
Account restrictions and asset arrest can immediately affect everyday life or business operations. We review those measures alongside the defense against the criminal allegation.

Money laundering – situation and central defense questions
| Situation | Central defense questions |
|---|---|
| Bank accounts and transfers | Where did the funds come from? What consideration or economic purpose explains the payment? |
| Cash and other assets | How were acquisition, possession and origin documented? Who is the asset economically attributable to? |
| Business payments | Which contracts, invoices and services explain the transaction? Who was responsible internally? |
| Money mule / account used for others | What communications existed? What did the account holder know about sender, recipient and purpose? |
| Crypto and wallets | Who controls the wallet? Which exchange accounts, transaction paths and economic background exist? |
| Asset arrest / account restriction | What amount and which assets are affected? Does the alleged confiscation basis support the measure? |
Where a business context is involved, the defense is coordinated with our White-Collar Crime practice and, for digital assets, our Crypto practice.

Frequently asked questions about money laundering in Germany
Money Laundering under Section 261 StGB – Frequently Asked Questions
Money laundering under Section 261 StGB concerns certain dealings with objects derived from unlawful acts. The provision contains several separate forms of conduct and, in specific situations, liability for reckless failure to recognize the origin.
No. An unusual or suspicious payment may trigger an investigation, but it does not by itself prove criminal origin or the required knowledge.
Yes, depending on the legal measure. Accounts may be affected by asset-preservation or confiscation proceedings. The specific legal basis and scope must be reviewed.
A money mule is typically a person whose account is used to receive or forward funds for others. Criminal liability depends on what the person knew or recklessly failed to recognize and what conduct is alleged.
Yes. Crypto assets can be involved in German money laundering investigations. Wallet attribution and transaction history still have to be proved reliably.
A German asset arrest under Section 111e StPO is a provisional measure used to secure potential value-based confiscation. Its legal requirements and amount can be challenged.
A spontaneous explanation is usually not advisable. Complex transactions are easily described incompletely or inaccurately before the investigation file is known.
The basic offence under Section 261 StGB carries imprisonment of up to five years or a fine. Different sentencing ranges apply to particularly serious and other special cases.
That depends on the alleged criminal origin, conduct, knowledge and evidence. Dismissal may be possible where the suspicion is not sufficiently supported after review of the file.
Do not make rushed explanations about accounts, payments or the origin of assets.
