The law firm Mügge, Dr. Pitschel & Partner represents not only defendants, accused persons, or defendants in criminal proceedings in the field of criminal law, but also persons who have become victims of a criminal offense (victim representation).

Protection Against Violence

If you have become a victim of domestic violence or stalking, we can apply for a court order under the Protection Against Violence Act to protect you from further acts of violence. This order can be requested preventively and includes measures such as restraining orders, exclusion orders, and contact bans.

In the area of protection against violence, there is currently discussion as to whether the use of an electronic ankle monitor could be a possible measure to enforce contact bans and restraining orders under the Protection Against Violence Act (We reported on this in March of this year: The Electronic Ankle Monitor – Possible Use in Cases of Domestic Violence?

Dr. Anthea Pitschel gave an interview to the Stern-Mügge, Dr. Pitschel & Partner on this topic last week, in which she discussed the possibilities, difficulties, and legal requirements for the use of an electronic ankle monitor to prevent domestic violence: “An ankle monitor can save women’s lives”

Filing a Criminal Complaint

The prosecution authorities are obligated to investigate when they become aware of criminally relevant incidents. A criminal complaint can be filed informally by anyone who wishes to report a criminal offense. A criminal charge, on the other hand, must be filed in writing by the injured party within three months (§§ 77 et seq. StGB) and can be withdrawn until the conclusion of the proceedings.

Witness Assistance

Have you received a summons as a witness in criminal proceedings? As a witness, you have the right to an attorney as witness counsel pursuant to § 68b StPO. We accompany you to interrogations and explain your rights and obligations in advance. We can object to inadmissible questions and, if necessary, request access to the case files. Under certain circumstances, protective measures for witnesses are also possible, such as the exclusion of the public or the removal of the defendant during the interrogation (§ 274 StPO).

Accessory Prosecution

As a victim of a criminal offense, you can join the criminal proceedings as an accessory prosecutor, for example in cases of sexual offenses, assault, or defamation. Particularly vulnerable accessory prosecutors may be assigned legal counsel at state expense (§ 397a para. 1 StPO). Accessory prosecution gives you the right to actively participate in the proceedings, present evidence, and demand compensation. Accessory prosecution also makes it possible to assert claims for damages and pain and suffering directly in the criminal proceedings (adhesion proceedings).
